Labor Secretary Thomas Perez said Tuesday that the Department of Labor would release “in the coming months” its fiduciary redraft, stating that it was a “very important rule” and that DOL would continue its “due diligence” on the rulemaking.
Perez confirmed that the DOL was indeed moving ahead in reproposing its rule to amend the definition of fiduciary under the Employee Retirement Income Security Act — what he called the “rule to reduce conflicts” in the retirement marketplace — during a conference call with reporters to announce a newly proposed rulemaking regarding a 401(k) fee disclosure guide.
While there has been speculation in the retirement planning community as to whether DOL would indeed move ahead on the rule this year, DOL stated in its regulatory agenda its revamped rule would come in August.
The fee-disclosure guide plan would amend DOL’s rule 408(b)(2) to “require covered service providers to furnish a guide to assist plan fiduciaries in reviewing the disclosures required by the final [408(b)(2)] rule if the disclosures are contained in multiple or lengthy documents.

Costco Wholesale (COST) said Thursday that sales at stores open at least a year rose 2 percent, below the 3.3 percent increase analysts were looking for, according to Thomson Reuters. The warehouse club chain said consumer electronics sales fell. Same-store sales at L Brands (LTD), owner of the Victoria's Secret lingerie chain, also came in below expectations. Its drop of 5.5 percent was far deeper than the 1.1 percent decline analysts were projecting. Wall Street analysts are expecting 11 top retailers to report a 2.7 percent increase in same-store sales for November, according to Thomson Reuters. Excluding drugstore operators, which get two-thirds of revenue from prescriptions, that gain is estimated at 2.3 percent. Gap (GPS) will report its November sales after U.S. markets close. Retailers have been contending with low consumer confidence and the need to prod shoppers with bargains this holiday season, which has six fewer days because of a late Thanksgiving. The National Retail Federation on Sunday said U.S. shoppers had spent 2.9 percent less this year over the Thanksgiving weekend, the kickoff to the holiday season. The Conference Board, an industry group, said last week that U.S. consumer confidence fell in November after a sharp drop in October as Americans worried about their future jobs and earnings prospects. The Company has management agreements with third parties to manage its hotels. The Trust's hotel managers provide managerial and other hotel employees, oversee operations and maintenance, prepare reports, budgets and projections and provide other administrative and accounting support services. Its management agreements provide for base management fees ranging from 1% to 4% of gross hotel revenues and incentive compensation if hotel operating income. Of its 12 hotels, seven operates pursuant to franchise agreements from international hotel companies. The Trust�� lease agreements are inter-company agreements between its property-owning subsidiaries and its TRS lessees.

After five days of losses, the Dow Jones Industrial Average gained 0.6% to 15,928.56, while the S&P 500�rose 0.6% t0 1,792.50, ending its three-day losing streak. The Dow got a boost from Pfizer (PFE), Visa (V) and General Electric (GE), while the S&P 500′s biggest winners included homebuilder DR Horton (DHI) and T. Rowe Price (TROW).
